Correct - the horizontal angulation is incorrect, causing the overlap between the teeth.

Remember that the central rays that come from the tube head must be directed through the interproximal spaces to open up the contact points. Additionally, the patient did not close her/his mouth adequately. Consequently, the crest of the alveolar bone cannot be seen on the maxillary teeth.
